Employment At Will
In New York State, most employment relationships are considered to be "at will" relationships. In the absence of an agreement to maintain the relationship for a fixed period of time, the relationship is presumed to be terminable at will. This means that an employer may fire an employee, or an employee may resign his or her position, at any time for any reason.
Exceptions do exist to the "at will" presumption. The most obvious exception is when the parties have an agreement which explicitly defines the length of the employment term. In other cases, the parties may have an agreement limiting an employer's ability to terminate to situations where "just cause" exists. In some cases, documents may create rights in the employment relationship even if the document is not formally titled an "employment contract."
